Compensation for damages and compensation for harm to health
I focus closely on the area of compensation for damages and non-pecuniary damage, especially personal injury, especially from traffic accidents and work accidents, or occupational diseases. In the case of traffic accidents, the law gives the injured party a direct right against the insurer. In the case of work-related accidents and occupational diseases, this right exists against the employer, but the legal insurer enters into the negotiations and possible dispute, and usually actively resolves the insured event on behalf of the employer. If the client has suffered non-pecuniary damage to health, I will contact an expert on behalf of the client in the relevant field of expertise for the assessment of non-pecuniary damage to health in order to prepare an expert opinion, which then serves as a basis for negotiations with the insurance company or even a possible lawsuit. The assessment is carried out either according to the Methodology of the Supreme Court, where permanent consequences are assessed from the perspective of the final impacts and limitations in the life of the injured party, or in employment-law relations according to Government Regulation No. 276/2015 Coll. Where appropriate, I act as a representative of the injured party in criminal proceedings.
Law of insurance
I focus closely on exercising the rights of insurance clients to insurance benefits, including in the area of so-called fixed-sum benefits, such as life and accident insurance, daily benefit insurance, and disability insurance.
Inheritance proceedings and real estate and property
I assist clients in matters of inheritance proceedings, including related disputes between heirs. I also deal with legal relations to real estate, review and draft purchase contracts or easement agreements, analyze complex and intertwined legal relations, and, if necessary, mediate attorney escrow for real estate transactions (I do not conduct the escrow myself). I can officially verify the signatures of the participants in transactions. It is always good to prevent disputes, or when considering initiating a lawsuit or, if necessary, participating in it, to know your position realistically and possibly reach a reasonable agreement even at the cost of compromise. Or, conversely, to fight fiercely in the event of injustice.
Contracts
I draft and revise contracts of all kinds and analyze already concluded contracts for my clients, e.g. contracts for work. It is always good to prevent disputes, or when considering initiating a lawsuit or, if necessary, participating in it, to know your position realistically and possibly reach a reasonable agreement even at the cost of compromise. Or, conversely, to fight fiercely in the event of injustice.
Family law, criminal cases
I selectively take on representation in matters of divorce, child custody and alimony. I respect the so-called Cochem practice; for this reason, when deciding whether or not to take on a case, I emphasize the attitude of the person interested in legal services towards the case, so that we can understand each other well later.
I approach taking on the defense in criminal proceedings in a similarly selective manner, but if I am appointed as a defense attorney by the court (as an “ex officio” defense attorney), which is also part of my practice, I usually have to accept such a client – even in such a case, however, I do the maximum of what my role as a defense attorney entails. As an elected defense attorney, I managed, for example, to achieve the acquittal of a participant in a traffic accident thanks to a careful analysis of a technical expert opinion on the issue of the analysis of the accident event.
Czech citizenship
I have knowledge and experience with the recognition/acquisition of Czech citizenship by declaration for our compatriots living abroad. Unfortunately, we are still waiting for an amendment to the current law (the so-called Winton Children Act), which would allow the acquisition of Czech citizenship not only for those compatriots, who lost our citizenship, and their descendants, but also for the descendants of compatriots who never lost our citizenship, but whose descendants born abroad did not acquire Czech citizenship at a certain time. Otherwise, I can also help with the process of acquiring citizenship by naturalization, but it is necessary, among other things, to maintain actual residence in our country.
